These Terms and Conditions govern access to the site lapepia.it and the purchase of LAPEPIA-branded products. By browsing the site or purchasing a product, you fully accept what is set out here, including the documents referenced by hyperlink (Privacy Policy, Refund Policy, Shipping Policy).

The store is hosted on the Shopify Inc. platform, which provides the technological infrastructure for selling the products.

1 — Requirements for Access to the Service
By accessing the Service, you declare that you are of legal age in your state or province of residence. You may not use the products or content of the site for illegal or unauthorized purposes, or violate applicable laws in the destination jurisdiction, including copyright regulations. Transmitting harmful code, malware, or computer viruses is prohibited. Violation of any provision results in the immediate termination of your right to use the Service.

2 — Conclusion of the Contract
An order is concluded by following these steps: product selection, entry of shipping and billing details, choice of payment method, order summary review, final confirmation. Before confirming the order, you may review and correct the entered data by returning to previous checkout screens.

A copy of the contract (order summary, price, purchased products) is sent to the email address provided at the time of purchase and remains accessible in the account area, orders section. The contract is concluded in Italian; for purchases made through the English version of the site, the contract is concluded in English.

The contract is considered concluded at the moment LAPEPIA confirms acceptance of the order, via confirmation email.

3 — Prices and Changes
Product prices may be changed at any time, without notice. Such changes do not affect already confirmed orders: the price applied is always the one shown at the time of order confirmation.

LAPEPIA reserves the right to modify or suspend the Service, or part of it, at any time, without liability to users for the consequences of such suspension, except for already confirmed and not yet fulfilled orders, which remain valid under the agreed terms.

4 — Products and Availability
Some products or collections are available in limited quantities and may be subject to sell-out. Returns and replacements are governed exclusively by the Refund Policy.

Every effort has been made to accurately represent the colors and textures of the fabrics; however, the rendering on device screens may vary from the actual material. LAPEPIA reserves the right to limit sales of a product, the quantity per order, or access to certain geographic areas.

5 — Use of Accessories with Rigid or Mechanical Components
Some LAPEPIA products (such as pacifier clips and teething rings) are designed and tested in accordance with the relevant European standards (UNI EN 12586 for pacifier clips, EN 71-3 for material safety). Use in accordance with the safety instructions provided on the Care & Maintenance page — including length limits, the prohibition of use during sleep, and recommended replacement intervals — is an essential condition for correct and safe use of the product. LAPEPIA is not liable for damage resulting from use that does not comply with these instructions.

6 — Orders and Customer Accounts
LAPEPIA reserves the right to refuse or cancel an order, including in cases of suspected fraud, pricing or availability errors, or violation of these Terms. In such cases, any amount already paid will be fully refunded.

Quantity restrictions may apply per person, household, or transaction, including orders placed from the same account, with the same credit card, or sharing the same billing or shipping address. In the event LAPEPIA modifies or cancels an order, the customer will be informed via the contact details provided. It is the customer's responsibility to provide accurate, complete, and up-to-date purchase and account information.

7 — Right of Withdrawal and Legal Warranty
The right of withdrawal is governed by the Refund Policy, pursuant to Articles 52 et seq. of the Italian Consumer Code. The legal warranty of conformity provided under Articles 128 et seq. of the Italian Consumer Code also remains valid for all products and cannot be limited by these Terms. For consumers residing in other European Union Member States, the conformity guarantee provided under the national legislation implementing Directive (EU) 2019/771 also remains valid.

8 — Intellectual Property
Content, images, text, and the LAPEPIA trademark are protected under intellectual property law. Reproducing, duplicating, copying, selling, or exploiting any part of the Service or products without express written authorization is not permitted.

9 — Third-Party Tools
The site may provide access to tools managed by third parties (such as review or payment systems), over which LAPEPIA has no direct control. Access to such tools is provided "as available," without guarantee of continuity, and at the user's own risk.

10 — External Links
The site may contain links to external platforms not affiliated with LAPEPIA. LAPEPIA is not responsible for the content or accuracy of such sites, nor for any damages related to purchases made through external channels.

11 — Comments and Suggestions
Ideas, suggestions, or materials spontaneously submitted through the site or other channels may be freely used by LAPEPIA, with no obligation of compensation or confidentiality, unless they constitute protected creative material submitted for different, specifically agreed purposes. The use of false identities or fictitious email addresses to send communications is prohibited.

12 — Processing of Personal Data
The processing of personal data collected through the site is governed by the Privacy Policy.

13 — Errors and Omissions
The site may occasionally contain typographical errors or inaccuracies relating to product descriptions, prices, shipping times, or availability. LAPEPIA reserves the right to correct such errors and, if necessary, to cancel an affected order, promptly informing the customer and issuing a full refund.

14 — Prohibited Uses
It is prohibited to use the site or its content for: unlawful purposes or to induce third parties to commit illegal acts; violating laws or regulations; infringing the intellectual property rights of LAPEPIA or third parties; engaging in discriminatory, defamatory, offensive, or dignity-violating conduct; spam, phishing, scraping, or crawling activities. LAPEPIA reserves the right to suspend access to the Service in the event of a violation.

15 — Limitation of Liability
The Service and products are offered according to the best available standards. Nothing in these Terms limits or excludes: LAPEPIA's liability for death or personal injury caused by its own negligence; consumer rights provided under the Italian Consumer Code, including the right of withdrawal and the legal warranty of conformity; any liability that cannot be limited or excluded under Italian law.

To the extent permitted by law, LAPEPIA is not liable for indirect or consequential damages not reasonably foreseeable at the time the contract was concluded, arising from use of the Service that does not comply with these Terms.

16 — Indemnification
To the extent permitted by law, anyone using the Service agrees to indemnify LAPEPIA against third-party claims arising from their own use of the Service in violation of these Terms or applicable laws.

17 — Severability
Should any provision of these Terms be deemed void or unenforceable, the remainder of the document will continue to apply, and the provision in question will be interpreted in the manner closest to its original intent, to the extent permitted by law.

18 — Termination
These Terms remain in effect until otherwise communicated. In the event of a serious violation by the user, LAPEPIA may suspend access to the Service, without prejudice to already accrued rights (confirmed orders, right of withdrawal, legal warranty).

19 — Entire Agreement
These Terms, together with the documents they reference, constitute the entire agreement between the user and LAPEPIA regarding use of the Service.

20 — Governing Law and Jurisdiction
These Terms are governed by Italian law. For disputes relating to contracts concluded with a consumer, the competent court is mandatorily that of the consumer's place of residence or domicile, pursuant to Article 33, paragraph 2, letter u) of the Italian Consumer Code.

21 — Changes to the Terms
The most up-to-date version of these Terms is available at any time on this page, with the date of last update indicated. Changes have no retroactive effect on already confirmed orders.
